This website, yeswescan.ca, is operated by Jennifer Audrey McFarlane, operating as Yes, We Scan! ("YWS", "we", "us"). By using this website, you agree to these terms. If you do not agree, please do not use the website.

1. Who the website is for

The website is intended for organizations evaluating document scanning and digitization services for their own records. You may use it to learn about our services, estimate the size of a project, and contact us.

2. What you may not do

You may not, and may not allow anyone else to:

• (a) copy, scrape, harvest or extract content, pricing, estimates or other data from the website by automated means, including bots, crawlers, spiders or scripts, other than search engines indexing the site for public search;
• (b) reproduce, republish or distribute the website's text, images, design, estimator or pricing information, in whole or in part, without our written permission;
• (c) use the website, its estimator or its request forms to gather information about YWS's pricing, methods or operations for use in a competing business;
• (d) submit false, misleading or automated requests through any form, including requests for a free trial or a quote that your organization does not genuinely intend to consider;
• (e) try to interfere with, test the security of, or gain unauthorized access to the website or the systems behind it; or
• (f) use the website in any way that breaks the law.

We may block access, decline requests, or cancel any trial or quote connected with a breach of this section.

3. Estimates are not quotes

3.1 The project estimator and any prices or ranges on the website are general guidance only. They are based on assumptions, such as an average number of pages per box, that may not apply to your records.

3.2 An estimate is not an offer, a quote or a commitment to provide services at any price. YWS provides binding pricing only in a written quote, after assessing your records. Any written quote is confidential to your organization.

4. Ownership of content

The website and its content, including text, photographs, graphics, the estimator, the design and the Yes, We Scan! name and logo, belong to YWS or its licensors and are protected by copyright and trademark law. Client names and testimonials appear with permission and remain the property of their owners. Nothing in these terms gives you a licence to use any of this content, except to view it for the purpose in section 1.

5. Free trial and services

Requests for a free trial are subject to the Free Trial Terms. Paid projects are governed by a written service agreement signed by both parties. If those documents conflict with these terms, those documents prevail for the matters they cover.

6. Privacy

Our Privacy Policy explains how we collect, use and protect personal information submitted through the website.

7. No warranty

We work to keep the website accurate and available, but we provide it "as is". To the extent permitted by law, we make no warranty that it will be error-free, uninterrupted or free of harmful components.

8. Limitation of liability

To the extent permitted by law, YWS is not liable for any loss or damage arising from your use of, or inability to use, the website, including any reliance on an estimate. This section does not limit our obligations under a signed service agreement.

9. Links to other websites

The website may link to other websites. We are not responsible for their content or their privacy practices.

10. Changes

We may update these terms at any time by posting a new version on this page. The version in effect when you use the website applies.

11. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario, sitting in Ottawa, have exclusive jurisdiction over any dispute about them.
